I have read and understand this agreement and am bound by its terms and conditions.

Contract & information

It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both Phillip Cullinane Photography and the client, in writing. Once booking fee is paid you are bound to the contract terms and conditions.

BOOKING FEE: A booking fee is required at the time of booking, together with this contract. Dates are reserved for 10 days and confirmed only when this booking fee is paid.

Upon signature, the photographer reserves the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the booking fee is NON-REFUNDABLE, if event is cancelled for any reason, including, but not limited to acts of God, fire, extreme weather, break-up, and/or financial hardship. Booking fee is to be paid at time of parties signing this contract. Booking fee is applied towards the contracted photography package upon completion of this contract. If, for any reason, client changes event date, the booking fee can be transferred to new event date if photographer has the date available; otherwise there is no refund for booking fee paid.

NB* During the current Covid-19 pandemic a booking fee may be transferred to another date if that date is available with in the calender booking date.

BALANCE PAYMENT: A remaining balance is to be made prior to or on to the Wedding date. Payment for additional album photographs, prints & frames is made after the wedding at the time of ordering.

STORAGE: Images will be stored for up to 12 months after the wedding date and available online for this period. Album picks should be chosen within this period. Due to the nature and substitution of products by suppliers, some product substitution may occur to Clients but will always be of like value.

Archival of Images: After you receive your images, Phillip Cullinane  Photography archives the photos for a total of 12 MONTHS. (please make sure you download the images not only on your computer, but please also have a form of back up EX: FLASHDRIVE OR EXTERNAL HARD DRIVE. Further enhancements /photo requests can be requested up until 90 days after the date of the  delivered images . After the 90th day any excess images with exceptions of the edited ones will be purged from my system entirely . It is up to the contract signees to sit down and allow adequate time to review all images once delivered and request any further enhancements within this timeframe.

CREATIVE LICENCE: Phillip Cullinane Photography shall be granted creative and artistic licence in relation to the choice of locations and poses used. Our judgement on photographic style and the number of photographs taken, shall be deemed correct. Due to changes of the weather and the availability and willingness of subjects Phillip Cullinane Photography will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

VIEWING: Viewing will be done by logging into your own online account where you can choose your images for our album.

COPYRIGHT: The 2000 Copyright and Related Acts assigns copyright to Phillip Cullinane Photography. You may not copy the photographs taken under this contract, or allow copies to be made photographically, electronically, or by any other means without expressed permission from Moat-Hill photography. Where a customer package includes a hi resolution USB of the final images which is produced by the photographer in jpg format Phillip Cullinane Photography grants permission to make unlimited number of copies and/or reprints of any images and may reproduce the images for non-commercial personal purpose, with no additional charges from the Company.

EXCLUSIVITY: Phillip Cullinane Photography shall be the sole professional (still) photographers at the venues specified. We do however positively encourage family, friends, and other guests to take photographs throughout the day.

Wedding Coverage Time

Wedding Collection I approx 10 Hours. Wedding Collection II Approx 10 Hours.

Wedding Collection III Approx 6 Hours

Wedding Collection IV Approx 4 Hours

Video

Complementary Highlight Film is not a full day video coverage.

Included Album of approx 21x21 in size and gift box included - Album is with photo cover padded and gloss pages - upgrades are available at extra cost.

FORCE MAJEURE: In the unlikely event of total photographic failure, injury or sickness beyond Phillip Cullinane Photography control, their liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected. Phillip Cullinane Photography has full Public Liability, and Professional Indemnity Insurance.

For a booking involving a church ceremony or at certain venues - the priest, minister, or hotel manager sometimes restricts the photographer’s movements. The area from which the photographer is able to cover may not be the photographer’s choice, and the photographer cannot accept responsibility for any obstructed view should this be the case. The use of artificial lighting may also be restricted or prohibited.

CANCELLATION: If Phillip Cullinane Photography has to cancel this contract for reasons beyond their control, (death, injury, sickness etc.), their liability shall be limited to a full refund of all monies paid. After a period of 14 days from the date of signing the contract, as compensation for loss of income for Phillip Cullinane Photography the following charges apply as a percentage of the total fee due *Note not applicable for Covid related cancellations. (Number of days before the wedding) 60 days or less - 100% 61-90 days - 75%. 91-120 days - 50%. Should the cancelled wedding turn out to be a postponement, then, subject to availability, all money paid may be applied to the new wedding date. In the event of Phillip Cullinane Photography taking another wedding booking for your cancelled or postponed date a full unconditional refund of your booking fee and monies paid shall be made. Phillip Cullinane Photography can not be sused no more than the fee paid.

PRIVACY: Phillip Cullinane Photography will store your name and wedding details on a private internal database. These details will not be made available to companies or individuals outside of Phillip Cullinane Photography.

Once booking fee payment  is paid you understand this agreement and bound by its terms and conditions.
